1) Scope of Application
The following terms and conditions apply to the use of our services and orders.
2) Registration and Use of Accounts
2.1 The use of our services does not necessarily require the creation of a user account with us. However, you have the option to register, for instance, to use GPT-4. Registration is free.
2.2 You are responsible for all activities that occur under your account and agree to keep your password secure and not share it with third parties. If you become aware of any unauthorised use of your account, you must notify us immediately.
3) Contracting Party, Contract Conclusion
3.1 The purchase contract is concluded with (GULL AG – Käferholzstrasse 261 – 8046 Zurich – info@gull.ch).
3.2 By making tokens available on our website, we make a binding offer to conclude a contract for these products. The contract is concluded when you click on the PayPal button to purchase a token package and confirm the purchase on the PayPal page. By confirming the purchase on the PayPal page, you accept the offer. The same applies to payment methods via credit card and TWINT.
3.3 Please note that the final conclusion of the contract also requires the successful completion of the payment via the payment method you used. If the payment is not properly processed for any reason, the contract is considered not concluded.
4) Contract Language, Storage of Contract Texts
4.1 The language available for the conclusion of the contract is German.
4.2 We store the contract text and provide the details of your token purchases. You can view these in our platform under the “My Account” menu item, where the details of each purchase, including the number of tokens, amount paid, payment ID, status, and purchase date, are listed.
5) Digital Products
5.1 Our products are exclusively digital tokens that can be used to access the GPT-4 model on our platform. After payment, the corresponding tokens are credited to your account in real-time.
6) Terms of Use
6.1 The purchased tokens may only be used for the purposes specified on our platform. It is not permitted to transfer or sell the tokens to third parties.
7) Expiry of Tokens and Accounts, and Account Cancellation
7.1 For the effective administration and maintenance of our platform, we reserve the right to delete unused accounts and tokens after a period of inactivity of at least one year. The tokens will lose their value upon account cancellation.
7.2 This is done to ensure efficient use of our resources and to prevent users from claiming unused tokens after an extended period of inactivity. We recommend regularly accessing your account and using your tokens.
7.3 You have the right to delete your account at any time. Please note that when deleting your account, all stored data and purchased tokens will be permanently erased.
7.4 We reserve the right to delete your account and terminate the use of our services if you violate these Terms and Conditions or if we become aware of any misuse or illegal use of your account.
8) Changes and Termination of Services
8.1 We reserve the right to modify or discontinue our services at any time, including when our partnership with OpenAI or another service provider is terminated or due to circumstances beyond our control.
8.2 In the event of a substantial change or termination of our services, we will endeavour to notify you in advance and take all necessary measures to minimise the impact on you. This may include, depending on the circumstances, a full or partial refund of any remaining token balance.
8.3 However, we do not guarantee and accept no liability for any changes, malfunctions, interruptions, or discontinuation of our services, and we cannot guarantee refunds or other forms of compensation in such cases.
8.4 In the event of service termination due to circumstances beyond our control, we will endeavour to refund remaining token balances as far as our capabilities allow. However, we cannot guarantee full refunds.
9) Prices and Payment Terms
9.1 The prices of our products are indicated in the product description and include VAT. Currently, payment can only be made via PayPal.
10) Warranty
10.1 The warranty is provided in accordance with legal provisions.
11) Changes to the Terms and Conditions
11.1 We reserve the right to modify these Terms and Conditions at any time and without prior notice. Changes will be published on our website. Your continued use of our platform after these changes indicates your acceptance of the revised terms. It is your responsibility to periodically review the Terms and Conditions and stay informed of any changes.
